Partner, Holiday Claims
Ross leads our Travel and Tourism Department having previously worked in the Domestic Personal Injury team of the Kingston-upon-Thames office. Ross undertakes all forms of accident and illness work that occurs abroad spanning from Package Travel Regulation matters to Skiing Accidents. He has particular niche in Direct Right of Action claim, Montreal Convention and Athens Convention Matters. He loves the challenge of a jurisdictional argument.
Ross has specific skills in problem solving as well as litigation strategy and a distinct knack to be academic and find new arguments when appropriate for the need of his clients. He is a “no nonsense get results” character. He is approachable with a great deal of commercial and common sense to blend with his legal knowledge, and particularly enjoys colleagues approaching him for his advice and opinion.
After completing a Masters Degree, Ross entered the real world of work and commenced his legal career at RAC, Bristol. During this time he worked on legal advice lines to RAC members on all topics of law specialising in Family Law, Corporate Law, Employment Law, Intellectual property Law, Consumer Law and Road Traffic Matters as well as Criminal Defence work. He was then seconded to work with the Directors of RAC at their headquarters in London giving advice to the Directors and the company at large. This included mergers and corporate advice and commercial defence work.
Having been exposed to many areas of law, he felt he had a specific liking for injury law matters and importantly an inclination to help people. To assist people who are genuinely injured with recovering their deserved compensation and obtaining rehabilitation.
He joined the firm in 2006 and has built up a significant expertise in Travel Law. He has a specific interest in road traffic accidents arising out of accidents abroad and an in-depth knowledge of the relevant EU Regulations such as 44/2001 and 864/2007 (the Rome II Convention). He regularly uses this knowledge to get very good results for clients who have been unable to get the right legal help from less qualified people elsewhere. The nature of the claims means they are often complex and high value, requiring his extensive knowledge and know how in the area.
Ross enjoys the academics of Travel law and has had many notable cases reported in the media and legal reports. Ross is classed as Notable practitioner in Chambers and Partners; “Senior associate Ross Smith is increasingly well known for his work on more complex claims including direct actions in the UK against foreign insurers. Peers appreciate that”he is practical, gets to the point” and “has a keen sense of merit on a lot of cases and a realistic view on their prospects.”
