About No Win No Fee Compensation
At Simpson Millar Solicitors we specialise in making successful holiday compensation claims for holidaymakers who have fallen ill or suffered an accident whilst on holiday.
We accept holiday claims on no win no fee terms and we go out of our way to make sure that we are open and honest about what this means.
The key thing to remember about this method of funding is that, so long as you follow our reasonable legal advice, provide us with the information that we need to pursue your claim and provide us with information that is true and honest:
- There nothing to pay upfront
- There is nothing to pay if your claim fails
- Any payments payable upon making a successful claim are simply deducted from your compensation once this has been paid.
Q. What is a No Win No Fee agreement
“It is a way of funding a claim without you having to pay anything unless you win compensation.”
Q. What do I pay if I lose?
“You pay absolutely nothing if you have taken our reasonable legal advice and advice about insurance, have provided us with the information we need to act for you and have been truthful and honest with regard to your claim and the information provided”
Q. What is a Costs Protection Policy?
“An unusual policy that protects you if your claim is unsuccessful. You only pay for the policy if your claim is successful and you win compensation. You do not pay for the policy if your claim is unsuccessful.
“The policy will pay all your expenses (and your opponent’s costs if necessary) if your claim is unsuccessful – meaning you pay absolutely nothing.”
Q. How much is a costs protection policy?
“This depends on your personal needs and the value of your compensation claim.” As a guide:
- For claims worth less than £25,000 involving an illness on holiday the cost is £150 plus Insurance Premium Tax
- For claims worth less than £25,000 involving an accident and injury the cost is £250 plus Insurance Premium Tax
- For claims worth more than £25,000 special terms are available
Q. What do I pay if I win?
“When you have received your compensation award in your hand you then pay our success fee and you also pay for the costs protection policy.”
Q. What is a Success Fee?
“This is a percentage of your compensation that you agree to pay to us because we have taken the risk that we might not get paid anything if your claim is unsuccessful.
“The maximum we will ask you to pay is capped at 25% of any compensation you recover or are awarded”
