Holiday Compensation Offers at Christmas for Accidents and Illness
Should I accept an offer from a tour operator or holiday company now for my accident or illness that I suffered abroad?
Many customers that have suffered an accident or illness while on holiday at destinations such as Turkey, Spain, Greece, Egypt and the Caribbean (including places like the Dominican Republic and Mexico) may suddenly find themselves with offers of compensation from their travel company.
One potential reason for this is because at Christmas money can be tighter and tour operators may think that customers may accept lower offers of compensation for their accident or illness than they would at other times of the year.
The issue for the customers is should they accept low offers such as £500 for illness such as salmonella or £750 for a fracture that was caused by an accident at their hotel while abroad or on holiday.
It may be tempting to accept such low or derisory offers of compensation. However, you may obtain a lot more compensation if you consider instructing Simpson Millar LLP’s Holiday Claims team to represent you.
Guidelines issued by the Judicial Studies Board give an indication of the amount of compensation you may obtain if you suffer gastric illness including food poisoning.
According to the guidelines if you suffer varying degrees of disabling pain, stomach cramps and diarrhoea continuing for some days or weeks you may be entitled to between £600 and £2600.
If you suffer food poisoning causing significant discomfort, stomach cramps, alteration of bowel function and fatigue and hospital admission for some days with symptoms lasting for a few weeks but complete recovery within a year or two you may be entitled to damages between £2600 and £6300.
You may get a lot more than that if you go on to develop permanent symptoms including post-infective irritable bowel syndrome.
We represent hundreds of claimants that experience similar problems arising out of their gastric illness whilst on holiday. Bugs that our clients have contracted include salmonella, cryptosporidium, shigella, amoebic dysentery, campylobacter.
