Another pool incident leads to damages claim for UK holidaymaker
Simpson Millar is pursuing a compensation claim on behalf of a British holidaymaker who was hurt following an incident on a Turkish hotel waterslide.
When the incident occurred in September 2014 our client was enjoying his annual summer holiday at the Cornelia De Luxe Resort in Belek.
Heavy contact caused injury
Having slid down a waterslide in the hotel’s splash pool, his heels came into heavy contact with the pool’s hard bottom surface.
Suffering multiple injuries to his feet and heels, the 55-year-old had to attend the hotel’s medical centre, where he received numerous injections and sutures were applied to his wounds.
Since the accident our client has continued to experience pain, mobility restrictions and concerns for his overall wellbeing. His mobility severely impaired, he has been forced frequently to rely on others for help.
Compensation claim against hotel’s agent
We wrote to the booking agent, TUI (UK) Ltd, to pursue a claim for damages on behalf of the injured holidaymaker. Citing the Package Travel Regulations 1992, we alleged the firm was liable for the negligence of the establishment, which had allowed our client to use hotel equipment that was inherently dangerous.
“Such cases are happening more and more”
According to Simpson Millar’s Claire Rabbetts, such instances of neglect are increasing. “We are seeing more and more cases of this nature where hotel waterslides are dangerous due to either being poorly maintained, lack of supervision during use, lack of instructions or generally not being built to safety specifications. Any one of these factors can result in injuries.”
Claim is ongoing
At time of publication this remains a live case. “We are at medical evidence stage and the defendant is still within the protocol period,” Claire said. “In time it is possible that barristers will become involved, and it’s likely we will require evidence from a lawyer and an architect in Turkey. However, it’s too early at this stage for their involvement.”
