Compensation for illness at hotel in Turkey
Simpson Millar have successfully agreed compensation for a group of holidaymakers that sued Thomas Cook for a food poisoning bug suffered at the Club Cettia Hotel in the resort of Marmaris.
The Club Cettia is a favourite for many holidaymakers travelling to Turkey every year. The hotel features two freeform swimming pools and offers buffet style dining. The complex also boasts a vast activity and entertainment programme which means guests have everything they need without having to leave the complex.
Severe gastric illness
The group, that mostly involved families, suffered severe gastric illness causing some of them to require hospital treatment – and others to suffer significant continuing symptoms including irritable bowel syndrome.
Mr Ardern from Liverpool was staying at the hotel with his children as the sole guardian. A few days into the holiday he was hit by the bug that caused diarrhoea, stomach cramps and fever. His symptoms became do bad that he was in bed for two days and his children were forced to fend for themselves.
Mrs Sandhar experienced similar problems that caused her son to be so unwell that a doctor had to be called to the hotel room who applied intramuscular injections
Legal complaints against Thomas Cook
Paul Stevens, Simpson Millar’s Group Holiday Claims Manager, who dealt with the cases advised:
“My clients were able to pursue claims for their illness against Thomas Cook because the seemingly lacklustre hygiene standards were indicative of a likely breach of Turkish hygiene regulations. My clients all reported issues in relation to the food such as meat dishes that were insufficiently cooked and buffet food that was not being kept at temperatures that could be deemed safe.”
“Happily, the lawyers representing Thomas Cook admitted liability and we have since been able to agree individual settlement amounts – dependent on the severity of the symptoms”.
All of the settlements were for amounts that exceeded £2000 – clients that experienced on going symptoms received considerably more
While those represented by Simpson Millar would clearly have preferred to have not have gone through their terrible ordeal in the first place, they were very pleased with the outcome.
Mrs Sandhar commented that she was “Very happy with the service provided and with the come of our family holiday that had been spoiled due to illness whilst away.
Mr Ardern also revealed he was more than pleased with the outcome of his cases in saying that he thought the calibre of staff that dealt with his case was excellent and that he thought “Simpson Millar were great.”
