£5,000 compensation after illness wrecks celebratory Turkish holiday
Poor food and water hygiene at the Lykia World Hotel, Oludeniz has been identified as the cause of a gastric illness which wrecked a celebratory holiday.
Our client wanted to celebrate her 40th birthday at the Turkish resort accompanied by her partner and another couple, one of whom was celebrating his 50th birthday.
However, on the 4th day of the holiday in September 2013 our client, a retiree, fell ill, completely ruining the rest of her 7-night break.
Holiday ruined for everyone in party
She suffered with vomiting, loose bowel movements and excruciating stomach cramps several times a day.
“Our client was severely ill and continued to suffer with reflux for months afterwards,” Simpson Millar’s James Blower said.
According to a medical expert, the symptoms could last a couple of years.
“The rest of our client’s party were also ill, as well as many other people at the hotel, including the Thomas Cook rep,” James said. “After submitting a Letter of Claim we initially heard nothing from Thomas Cook. And although the firm finally admitted liability, this was subject to causation, obliging us to collect medical evidence.”
Defendant continued to argue claim value
“In due course we put forward a settlement offer to the defendant. While Thomas Cook recognised its fault for the hotel’s hygiene failures and our client’s illness, the firm continued to argue over the value of the claim.”
After a period of negotiation we were finally able to agree a settlement for our client.
“Our client was very upset that her vacation had been ruined,” James added. “The holiday was a birthday present from her partner for her 40th birthday, which proved to be a disaster because everybody was ill.”
“Scary…I’d sooner forget”
Our client said the holiday was a birthday present she would sooner forget.
“It left me feeling weak and drained. It was supposed to be an enjoyable experience, and to be away while you are ill is quite scary.”
The compensation settlement of £5,002.72 went some way to help recoup part of the holiday costs for our client, who expressed herself delighted with Simpson Millar’s service.
