Woman Wins £4000 Compensation From Thomas Cook for Tunisia Food Poisoning
A West Midlands woman has successfully sued Thomas Cook Tour Operations for salmonella food poisoning that she suffered from during a holiday to the Dar Khayam hotel in Tunisia.
Mrs Sivell was hoping for a relaxing break in the popular beach resort of Hammamet when she was struck down with sickness and diarrhoea, completely ruining her holiday.
The Dar Khayam is a three star hotel with facilities including a beach bar and restaurant along with outdoor and indoor swimming pools. Due to the illness Mrs Sivell was unable to enjoy the services of the hotel and the holiday and was unable to leave her room.
Hotel Salmonella Bug Detected
Upon her return to the UK she continued to suffer so Mrs Sivell submitted stool samples to her doctor which tested positive for salmonella food poisoning.
Salmonella is typically associated with poor hygiene practices and undercooked chicken and eggs. After consuming the bacteria, it will usually take between 24 or 36 hours for symptoms to show.
Because our client was staying at the hotel on an all-inclusive basis and did not leave the hotel in the couple of days or so before the symptoms started, the most likely cause of the infection was food served from the restaurant in the Dar Khayam.
In order to maximise her chances of making a successful claim she instructed us to represent her in a claim against Thomas Cook.
Simpson Millar LLP prepared a case on Mrs Sivell’s behalf and in pursuing the claim made 32 allegations of fault on the part of Thomas Cook and the hotel. An admission of liability was made by the travel company. This allowed holiday claims specialist Paul Stevens to concentrate on obtaining a medical report that dealt with the full extent of any continuing symptoms.
Once submitted, settlement was agreed with Thomas Cook in line with what Mrs Sivell was likely to be awarded had the matter proceeded to a trial in the sum of £4000.
